29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l)  (Construction Reference 1926.602):  (a) Location - 32 Hopkins Circle, Methuen, MA 01844 (Regency at Methuen Lot #25)  On or about 12/30/2013, an employee operating a rough terrain forklift to facilitate the construction of a residential structure was not trained or evaluated by their employer for their competency to safely operate a rough terrain forklift.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Location - 32 Hopkins Circle, Methuen, MA 01844 (Regency at Methuen Lot #25)  On or about 12/30/2013, employees engaged in the construction of a two story residential structure were not provided training from their employer in the recognition of fall hazards or the procedures to be followed to minimize their exposure to those hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) Location - 32 Hopkins Circle, Methuen, MA 01844 (Regency at Methuen Lot #25)  On or about 12/30/2013, employees engaged in residential construction activities more than six feet above the lower level were not protected from falling.  New Stars Construction Group, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 689318, citation number 1, item number 2 and was affirmed as a final order on 12/31/2012, with respect to a workplace located at 143 Lilac Lane, Prospect, CT 06712.
