29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) would be met. On or about December 12, 2013, the employer did not provide employees with information about the chemical and physical hazards of the stains and lacquers used to perform their job duties. Not informing employees exposed them to physical hazards such as fire or explosions and chemical hazards from inhalation or skin absorption of n-butyl acetate.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about December 12, 2013, employees in the paint building were exposed to hazards imposed by improper respirator use when the employer failed to provide Appendix D of the respirator standard and also failed to inform employees about the proper care and maintenance of the respirator issued for voluntary use.
