29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 2nd & Ocean Ave., Manasquan: The employer did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, two GS Brito Contracting employees installing sheathing on the roof of a three story new construction residential structure without any form of fall protection were exposed to a fall hazard of over 30 feet from the roof's edge to the ground. Observed on or about 12/26/2013. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. a) 2nd & Ocean Ave., Manasquan: Two GS Brito Contracting LLC employees installing sheathing on the roof of a three story new construction residential structure were not using any form of fall protection and were thus exposed to a fall hazard of over 30 feet from the roof's edge to the ground. Observed on or about 12/26/2013. The employer, GS Brito Contracting LLC dba Brito Construction, was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 419443, citation number 02, item number 001 and was affirmed as a final order on 07/12/2012, with respect to a workplace located at 212-234 Schuyler Ave., Kearny, NJ. The employer, GS Brito Contracting LLC dba Brito Construction, was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 315860759, citation number 01, item number 002 and was affirmed as a final order on 11/28/2011, with respect to a workplace located at Bldg 300 Kestrel Court, West Windsor, NJ.
