29 CFR 1926.1052(c)(6): The height of handrails was less than 30 inches (76 cm) from the upper surface of the handrail to the surface of the tread, in line with the face of the riser at the forward edge of the tread: a) On or about 12/30/13, on construction site at the former Fairmont Creamery Building, 199 Scott St., Buffalo, NY: Employees were exposed to a potential fall down the portion of the stairway leading from the Scott St. entrance to the basement. A stairrail system consisting of a top rail and a midrail had been in place at one time on the left side descending. The top rail had broken off months before, leaving the midrail to function as the handrail. The height of this handrail varied from about 17 to 19 inches above the upper surface of this handrail to the surface of the tread, in line with the face of the riser at the forward edge of the tread. NO ABATEMENT CERTIFICATION REQUIRED
