OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls:    (a) Dust Mill located at 1015 New South Harris Street, Dalton, GA 30722: Employees were elevated approximately 18-feet from the ground while working from the bucket of a International Harvest 510 Pay Loader which was used as an elevated work platform. Employees using the bucket as a work platform were not provided with a fall protection system and were exposed to falls over 18 feet to the lower level.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a) Dust Mill located at 1015 New South Harris Street, Dalton, GA 30722: Employees stood on the steel framework of the dust mill, while waiting for the Pay Loader operator to dump the contents of the bucket.  Employees were exposed to fall hazards of approximately 18-feet, 6-inches to the lower level when personal fall arrest systems were not provided/used.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  (a) Dust Mill located at 1015 New South Harris Street, Dalton, GA 30722: Employees holding onto the steel framework of the dust mill were exposed to fall hazards of approximately 18-feet, 6-inches to the lower level. The employer failed to assess the new limestone dust collection operation which exposed employees to fall hazards when personal fall arrest systems were not provided.
