29 CFR 1926.502(h)(1)(iii): The safety monitor wan not on the same walking/working surface and within visual sighting distance of the employee being monitored. The employer failed to protect employees from potential fall hazards associated with roofing a low slope commercial facility roof with a ground to eave height over 6'. The most recent example of this was found on the job site located at 6919 O Street, Lincoln, NE 68510 where the employer had 3 employees installing the membrane and drains on the awnings in the front of the new Best Buy store they are contracted to build without the benefit of any form of fall protection system in place. The working surface on the awning was less than 50' x 50' and ground to eave is approximately 11'4". Acceptable forms of fall protection include but are not limited to: i. Fall arrest or restraint systems. ii. Guardrail system. iii. Safety nets. iv. A dedicated monitor positioned on the same working surface as the exposed employees. v. Catch platform equipped with guard rail system and positioned within 14" of the edge and no more than 2' below the edge.
