29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) for the spoil pile of an excavation located at 4300 S Frontage Road in Lakeland (FL), as observed on or about 01/03/2014. The excavation was approximately 15-feet wide and measured 7-feet deep; the spoil pile was placed right at the edge of the north excavation wall while employees were working inside. The B.R.W. Contracting Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number314337098, citation number 1, item number 1 and was affirmed as a final order on 04/23/2010, with respect to a workplace located at Tampa Palms, Tampa Fl.

The south trench wall was benched at 76 degrees and the north trench wall was benched at 88 degrees. The B.R.W. Contracting Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 316355502, citation number 1, item number 1 and was affirmed as a final order on 04/23/2012, with respect to a workplace located at Family Dollar in Tampa Florida.
