Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or caught-in hazards: (a) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards while operating a Takumi CNC machine, model no. V15A, serial no. H0579, without a functioning interlock door device in the machining and fabrication area at 640 Arizona Avenue NW, Huron, South Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to install a functioning door interlock device on the Takumi CNC machine in accordance with ANSI B11.22, Safety Requirements for Turning Centers Automatic Numerically Controlled Turning Machines, paragraphs 6.21 Safeguarding and 6.21.2 Automatic Mode which states: 1. Paragraph 6.21: Machine shall be safeguarded whenever practical by fixed or interlocked movable guards. 2. Paragraph 6.21.1.2: Machine operation shall only be possible when the guards are closed and the safeguarding (protective) devices are active. If it is possible, in this mode, to open an interlocked moveable guard, the hazardous movement shall cease and be inhibited. If opening of the interlocked movable guard gives access to hazards, guard locking shall be provided.

(b) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by hazards where a 100-ton OTC H-Frame hydraulic press, part no. 60534, serial no. 1003, was operated in the fabrication area without barrier guarding at 640 Arizona Avenue NW, Huron, South Dakota. (c) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards while operating an IGM LIMAT robotics welder, order no. 97K0057US1, without barrier guarding at 640 Arizona Avenue NW, Huron, South Dakota. (d) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards while operating an IGM KUKA robotics welder, article no. 26F400, without barrier guarding at 640 Arizona Avenue NW, Huron, South Dakota. (e) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Gidding & Lewis Bickford radial drill, serial no. 952-00191-74, was operated in the machining area without chuck and/or chip guarding at 640 Arizona Avenue NW, Huron, South Dakota. (f) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where an Enco vertical milling/drilling machine, model no. 100-1500, was operated in the machining area without chuck and/or chip guarding at 640 Arizona Avenue NW, Huron, South Dakota. (g) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Delta drill press, model no. 70-200, serial no. 010415W1083, was operated in the machining area without chuck and/or chip guarding at 640 Arizona Avenue NW, Huron, South Dakota. (h) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Wilton drill press, model no. 2551, serial no. 181881, was operated in the machining area without chuck and/or chip guarding at 640 Arizona Avenue NW, Huron, South Dakota. (i) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where a Jet milling/drilling machine, model no. JMD-18PF, serial no. 7U58153, was operated in the machining area without chuck and/or chip guarding at 640 Arizona Avenue NW, Huron, South Dakota. (j) On or about December 17, 2013, and at times prior to that date, for employees exposed to struck-by and/or caught-in hazards where an Okuma CNC Bridge Mill, model no. MCR-A5C, serial no. 145555, was operated in the machining area without barrier guarding at 640 Arizona Avenue NW, Huron, South Dakota.
