29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  On or about January 17, 2014 at the worksite; an employee was working on an, approximately 11.2 ft high on the west side and approximately 15.5 ft. high on the east side, bay window roof with no conventional fall protection measures being used.  N&N Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 530319, citation number 1, item number 3 and was affirmed as a final order on November 13, 2012, with respect to a workplace located at 16330 Snow Rd., Brookpark, Ohio 44142.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years "and as referenced by the note contained in 1926.602(d)".  Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter.  On and before January 17, 2014 at the worksite; the employer operated an off-road PIV and had not been re-evaluated and certified within the past three years.
