29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501. The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about January 22, 2014, at the construction site where an employee was exposed to a 9 ft. 11 inches fall hazard when performing roofing activities on a residential structure without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. The employer does not ensure that the ladder side rails are extended 3 feet above the upper landing surface when used by an employee This violation was observed at the construction site on or about January 22, 2014 where an employee was exposed to a 9 foot 11 inches fall hazard when using a ladder without the ladder side rails extended 3 feet above the upper landing. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the ladder side rails are extended 3 feet above the upper landing surface.
