29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).     The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about September 16, 2015, on the south side of the residential home being constructed where an employee was exposed to an 18 feet 11 inch fall hazard when performing roofing activities without a fall protection system.    William Paz Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 955755, citation number 1 item number 1 and was affirmed as a final order February 10, 2014, with respect to a workplace located at 8606 Redstone Hill Dr., Katy, TX 77433.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.
