29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signaled that it is safe to do so.     (a)At the worksite - A Caterpillar Hydraulic Excavator, Model 321D used excavate trenches for water mains and sanitary sewers did not have a reverse alarm distingushable from the surrounding noise level.  The signalman was struck by the excavator while unrolling a hose;  on or about 01/25/14.     NOTE:   IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1,000.00 AS PER 29 CFR 1903.19
