29 CFR 1926.651(b)(1): The employer did not ensure that: The estimated location of utility installations, such as gas, electric, steam, fuel, sewer, water, telephone lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, shall be determined prior to opening an excavation: a) When excavating in a street the employer did not ensure that utility mark-outs were marked on the street before starting to excavate. The employer was digging a 9 ft deep pit in the street where there was an underground 8" gas line and other utility lines. Employees who were digging did not have readily visible mark-outs so as to see/ know utility locations while digging. Location: 800 E 14th Street, New York, N.Y. On or about 10/30/2014

29 CFR 1926.651(b)(2): The employer will instruct each employee in the recognition and avoidance of unsafe condition and the regulations applicable to his work environment to control or eliminate any hazards to others exposure to illness or injury. The employer will instruct and train employees that prior to any work being performed cutting or digging the appropriate marks outs are completed and visible. a) The employer did not allow the utility notification process to be completed before starting to dig the excavation. The employer called New York 811 utility notification service but started digging the excavation before any street mark-outs were done, as required by the 811 notification ticket. Location: 800 E 14th Street, New York, N.Y. On or about 10/30/2014
