OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to improperly maintained exterior walking/working surfaces:     a.) United Refining Company of Pennsylvania dba Kwik Fill Store #229, 5574 State Route 8, Harrisville, PA 16038 On or about January 30, 2014, and times prior thereto, employees were exposed to trip and fall hazards from the presence of pot holes.  These areas where the pot holes were located included, but were not limited to, the fuel pump area (diesel pump station # 6).

United Refining Company of Pennsylvania dba Kwik Fill Store #229, 5574 State Route 8, Harrisville, PA 16038, On or about January 30, 2014 and times prior thereto:  Company employees work with and around hazardous substances including but not limited to, diesel fuel, Aquaphenate, and (Spartan brand )concentrated window cleaner.  The company's Hazard Communication program was missing information including, but not limited to, the following:       1)      The designation of a specific person responsible for ensuring the labeling of containers in the facility;   2)      The description of the labeling system used in the facility;  3)      Procedures to review and update container label information when necessary;  4)      The designation of a specific person responsible for obtaining and maintaining the MSDSs or SDSs.   5)      The designation of a specific person responsible for conducting the Hazard Communication Training.   6)      The format of the Hazard Communication training program to be used.   7)      Procedures to train new employees at the time of their initial assignment and to train employees when a new hazard is introduced into the workplace.
