29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances were not allowed for aisles, at loading docks, through doorways or wherever turns or passage had to be made: (a) On or about January 29th, 2014, in the powered industrial truck battery charging and service area, employees were exposed to the potential of being struck by a falling battery or battery charger in that the MTC battery changing machine was striking parts of the adjacent storage racks causing the dislocation of a guarding apparatus and potentially causing the rack and/or a battery or its charger to become unstable and fall. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation of a powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) On or about January 29th, 2014, employees working in the battery changing, charging and servicing area were exposed to serious potential struck-by hazards in that at least two safety systems had been bypassed on the MTC PCH Model 232TSVG battery changing machine without the manufacturer's written approval. Specifically, the dead man switches under the operator's platform had been disabled, as well as the light beam system designed to prevent unintentional off-loading (i.e., dropping) of a battery. These modifications could result in a large industrial truck battery being dropped on an employee and/or the battery changing machine striking and destabilizing the entire rack of batteries and chargers. Abatement certification is required for this Item. Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
