29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) Prior to the OSHA inspection which was opened on January 22, 2014, no written hazard communication program had been implemented which described how the employer would provide for proper labeling (as required by section f), how the employer would maintain and make available material safety data sheets (as required by section g), and how the employer would provide information and training on chemicals hazards in the workplace (as required by section h).  Hazardous chemicals used in this workplace included, but were not necessarily limited to: propane fuel, primer, paints, thinner, various metal alloys (including stainless steel), that were subject to welding and grinding.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Prior to the OSHA inspection which was opened on January 22, 2014, information and training had not been provided to workers regarding information and warnings on container labels, how to read and understand material safety data sheets,  and information about the hazards of the chemicals in their work areas.  Hazardous chemicals used in this workplace included, but were not necessarily limited to: propane fuel, primer, paints, thinner (containing xylene and methyl ethyl ketone), various metal alloys (including stainless steel), that were subject to welding (resulting in hazardous fumes, including hexavalent chromium, a known carcinogen) and grinding.

29 CFR 1915.1026(j)(1):  The employer did not ensure that at least the following Chromium VI hazards were addressed when providing Hazard Communication Standard (HCS) 1910.1200 information and training: Cancer; skin sensitization; and eye irritation.   (a)    Prior to the OSHA inspection opened on January 22, 2014, workers having exposure to Chromium VI from stainless steel welding in the Fabrication and Assembly area were not provided information and training regarding the potential health hazards (including cancer, skin sensitization, and eye irritation) of Chromium VI.

29 CFR 1915.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):     (a) In the Fabrication and Assembly Area, during stainless steel barge building, welding and grinding was periodically performed on stainless steel.   However, prior to the OSHA inspection opened on January 22, 2014, the employer had not determined the 8-hour time-weighted average exposure for workers exposed to chromium (VI).

29 CFR 1910.36(d)(1): Employee(s) were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge:   (a) In Building 2 (AKA North Building), where spray painting operations were at times performed, a designated exit door on the east wall of the building was blocked by a wooden bar, which in a fire situation could impede ready egress from this area.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:   (a) Prior to the OSHA inspection opened on January 22, 2014, the employer had not provided workers with information  regarding the new format on labels received on shipped containers.  Nor had  the employer provide workers with information regarding the new format for safety data sheets.
