29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents. On or about January 30, 2014, on the west side of the construction site, employees were engaged in cornice activities with the use of pneumatic nail guns and were not wearing eye protection exposing employees to eye injuries.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about January 30, 2014, on the west side of the construction site, employees engaged in cornice activities working from the exterior top plate without fall protection were exposed to a fall hazard of approximately 25 feet to the lower level.
