29 CFR 1926.102(a)(1): Eye and face protective equipment was not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: West side of apartment complex construction. On or about May 25, 2016, an employee was exposed to the hazard of being struck by flying projectiles, while using a pneumatic nail gun to install cornices siding without the use of eye protection. Juan Fuentes was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 957377, citation number 1, item number 1 and was affirmed as a final order on 3/19/2014, with respect to a workplace located at 9300 Harmon Rd., Fort Worth, TX 76117.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). West side: On or about May 25, 2016, an employee was exposed to a fall hazard, while attaching cornice materials on an exterior wall of a residential apartment complex from the basket of a Genie S65 telescopic boom aerial lift without the use of a personal fall arrest system.
