29 CFR 1910.119(f)(1)(ii):  The employer's written operating procedures did not address the consequences of and the steps required for correcting or avoiding deviation from the operating limits.         The employer does not ensure written operating procedures addressed steps required for correcting or avoiding deviations from the safe upper and lower limits of the process.       The violation occurred on or about February 5, 2014 and at times prior thereto in the propane terminal areas where the employer failed to ensure written operating procedures addressed the steps required for correcting or avoiding deviations from the safe upper and lower limits of the process. Identified operating limits include but not limited to:    a.     High/Low liquid level   b.     High/Low pressure limits   c.     High/Low Flow Rates      This condition exposed employees to fire and explosion hazards.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure written operating procedures addressed the steps required for correcting or avoiding deviations from the safe upper and lower limits of the process.

29 CFR 1910.119(d)(3)(ii):  The employer did not document that the equipment in the process complied with recognized and generally accepted good engineering practices:         The employer does not ensure it documented that equipment in the process complied with recognized and generally accepted good engineering practices.       a.     The violation occurred on or about February 5, 2014 and at times prior thereto in the propane terminal where the employer failed to document bulk liquid hydrocarbon storage vessels complied with recognized and generally accepted good engineering practices such as ASME Section VIII and API 510. Identified vessels include but are not limited to VST-2100, VST-2140, VST-2150, and VST-2160.  This condition exposed employees to fire and explosion hazards.       b.     The violation occurred on or about February 5, 2014 and at times prior thereto in the propane terminal where the employer failed to document bulk liquid hydrocarbon storage piping complied with recognized and generally accepted good engineering practices such as ASME Section B31 and API 570. Identified piping includes but is not limited to piping from the bulk hydrocarbon storage vessels to the truck loading facility. This condition exposed employees to fire and explosion hazards.       NGL SUPPLY TERMINAL, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIPVALENT STANDARD, 29 CFR 1910.119(d)(3)(ii), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER #782862, CITATION NUMBER #1, Item# 1 AND WAS AFFIRMED AS FINAL ORDER ON MARCH 26, 2013 WITH RESPECT TO A WORKPLACE LOCATED AT WEST MEMPHIS TERMINAL 1282 S 8TH STREET, WEST MEMPHIS AR 73201.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure it documents that equipment in the process complies with recognized and generally accepted good engineering practices.

The employer does not ensure inspections and tests performed on process equipment to maintain its on-going mechanical integrity followed recognized and generally accepted good engineering practices.       a.     The violation occurred on or about February 5, 2014 and at times prior thereto in the propane terminal where the employer failed ensure inspections and tests of bulk liquid hydrocarbon storage pressure vessels followed recognized and generally accepted good engineering practices such as API 510. Identified vessels include but are not limited to VST-2100, VST-2140, and VST-2150.  This condition exposed employees to fire and explosion hazards.       b.     The violation occurred on or about February 5, 2014 and at times prior thereto in the propane terminal where the employer failed ensure inspections and tests of terminal hydrocarbon piping followed recognized and generally accepted good engineering practices such as API 570. Identified piping includes but is not limited to hydrocarbon in the terminal from the storage vessels to the truck loading facility. This condition exposed employees to fire and explosion hazards.
