29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  On or about February 6, 2014,  at the above addressed jobsite, the employer permitted employees to use dust masks and half mask respirators when dry cutting concrete posts with a saw, without providing employees with information contained in Appendix D of CFR 1910.134.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103):  On or about February 6, 2014, and times prior there to, at the above addressed jobsite, the employer provided tight-fitting respirators to employees to wear, without providing a medical evaluation, when cutting concrete posts during sea wall construction operations.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about January 30, 2014, at the above addressed jobsite, the employer did not develop a hazard communication program for employees who are exposed to hazardous chemicals such as, but not limited to, gasoline, silica, oxygen, and acetylene, when performing sea wall construction.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about February 6, 2014, at the above addressed jobsite, the employer did not provide training to employees on the hazards of silica during seawall construction operations where employees cut concrete pilings.
