29 CFR 1926.25(a):   During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:    (a) At the front entrance of the construction site, straps of lumber with protruding nails were observed around the area creating a puncture hazard for those employees not wearing work boots as observed on or about February 5, 2014.

29 CFR 1926.96:   Safety-toe footwear for employees shall meet the requirements and specifications in American National Standard for Men's Safety-Toe Footwear, Z41.1-1967.  [58 FR 35152; June 30, 1993]    (a).  At the construction job site located at 3255 Sedge Drive, employees were allowed to wear soft sole tennis shoes which did not provide proper foot protection from punctures and falling material that may strike the feet of the employee.

29 CFR 1926.102(a)(1):   Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    (a) At the construction jobsite in Viera, employees using pneumatic nail guns during wood frame construction were not using eye or face protection to safeguard them from being struck-by projectiles and debris.

29 CFR 1926.501(b)(1):   Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest:    (a)  On the second floor balcony of the construction jobsite, an employee was observed working from a step ladder. No fall protection was used  where unprotected sides of the balcony presented a fall hazard of 11 feet to the ground below as observed on or about February 5, 2014.

29 CFR 1926.405(g)(2)(iv):   Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:    (a)  Flexible power cord jumpers that were being used at the jobsite did not have strain relief as observed on or about February 5, 2014.    Keith Bennett Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 921601, citation number 01, item number 01 and was affirmed as a final order on October 21, 2013, with respect to a workplace located at3018 Cortona Drive Lot-5b, Viera, Florida.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)  At the jobsite located in Viera, Florida where wood frame construction was being performed, employees were not protected from fall hazards by conventional or alternative fall protection exposing them to 11 and 20-foot fall hazards as observed on or about February 5, 2014.     Keith Bennett Construction was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 748921, citation number 01, item number 01 and was affirmed as a final order on February 13, 2013, with respect to a workplace located at Lot 18-C of the Viera subdivision development.
