OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by debris, burned by chemicals and inhaling toxic vapors from an exploded drum. Location - Passivation Area: On or about February 10, 2014, a nitric acid solution was transferred from a process tank to a fifty-five gallon drum. During the transfer, the nitric acid solution reacted with the contents of the drum in which it was being transferred. The reaction resulted in the formation of vapors and increased the pressure inside the drum. The pressure eventually caused the drum lid to blow off causing severe damage to the building and injuring several workers. 29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. Location - Storage Building: On or about February 11, 2014, the wiring and equipment used to power a diesel fuel pump in a hazardous location were not approved for a Class 1, Division 1 location.
