29 CFR 1910.215(a)(4):  Work rests.  On offhand grinding machines, work rests shall be used to support the work.  They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage.  The work rest shall be securely clamped after each adjustment.  The adjustment shall not be made with the wheel in motion:   a.  In the weld shop, the work rest on the left side of the Porter Cable grinder (S/N:  054832) was adjusted one-half inch from the abrasive wheel which exceeded the maximum opening of one-eighth inch.

29 CFR 1910.215(b)(9):  Exposure adjustment.  Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel.  The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.):   a.  In the weld shop, the adjustable tongue guard on the left side of the Porter Cable grinder (S/N:  054832) was one-half inch from the abrasive wheel which exceeded the maximum opening of one-fourth inch.   b.  In the weld shop, the adjustable tongue guard on the right side of the Porter Cable grinder (S/N:  054832) was three-eighth inch from the abrasive wheel which exceeded the maximum opening of one-fourth inch.

29 CFR 1910.134(c)(2)(ii):  In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user.  Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks):     a.  At the grain elevator, the employer did not ensure that any employee voluntarily using a half-facepiece Survivair Premiere negative pressure respirator with P100 cartridges was medically able to use that respirator and that the respirator was stored in a clean condition.

29 CFR 1910.272(j)(4):  Grain and product spills shall not be considered fugitive grain dust accumulations.  However, the housekeeping program shall address the procedures for removing such spills from the work area:   a.  At the grain elevator, the employer's Housekeeping Program did not address the procedures for removing grain and product spills.

29 CFR 1910.272(m)(3):  A certification record shall be maintained of each inspection, performed in accordance with this paragraph (m), containing the date of the inspection, the name of the person who performed the inspection and the serial number, or other identifier, of the equipment specified in paragraph (m)(1)(i) of this section that was inspected:   a.  At the grain elevator, the employer did not maintain certification records for inspections performed on equipment including, but not limited to, the following:  annual inspections of the Myers ME 1400 continuous flow dryer and daily inspections of the four bucket elevators for belt alignment and loose buckets.
