29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. a. The employer has failed to submit abatement certification and documentation within ten days of the abatement date, August 8, 2015, for a violation of 29 CFR 1910.95(k)(1), issued as citation 1, item 3, and described as follows: a. At the work site, the employer required all employees to wear hearing protection at all times in their work areas where they were exposed to hazardous noise. The employer did not ensure that all employees wore the required hearing protection during their shift. b. At the work site, the employer required all employees to properly wear hearing protection at all times in their work areas. Employees were observed both improperly inserting hearing protection and wearing improperly inserted hearing protection.

29 CFR 1910.95(i)(3): Employees shall be given the opportunity to select their hearing protectors from a variety of suitable hearing protectors provided by the employer. a. At the work site, employees were required by the employer to wear hearing protection throughout the plant. The employer routinely offered only one type of hearing protection to employees as they received their personal protective equipment at the beginning of each shift.

29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. a. At the work site, the employer required employees to wear hearing protection in the production areas of the plant where hazardous noise was present. The employer had not adequately trained employees about the hearing protection program in that employees of various ethnic backgrounds, for who English and Spanish were not native languages,were trained about the hearing protection program with materials in English and Spanish.

The employer had not adequately trained employees about the hearing protection program in that: a. At the work site, the employer required all employees to wear hearing protection at all times in their work areas where they were exposed to hazardous noise. The employer did not ensure that all employees wore the required hearing protection during their shift. b. At the work site, the employer required all employees to properly wear hearing protection at all times in their work areas. Employees were observed both improperly inserting hearing protection and wearing improperly inserted hearing protection.
