29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment.  The employer does not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment. This violation occurred on or about February 16, 2014, in the boiler room where the employees operating the Industrial Boiler Co., Inc. boiler, Model WWH500-250, SN RMP500-20, were exposed thermal hazards between approximately 900-1400 degrees without an assessment to determine if hazards were present that would necessitate the use of personal protective equipment.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that an assessment of the workplace is performed to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment.

29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:   The employer does evaluate the workplace to determine if any spaces were permit-required confined spaces. On or about February 17, 2014, and times there prior to, employees in the boiler room were exposed to an engulfment hazard when enter the firebox of an Industrial Boiler Co., Inc. boiler, Model WWH500-250, SN RMP500-20, for maintenance and inspection. The employer did not evaluate the space to determine if it was a permit-required confined space.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the workplace is evaluated to determine if any spaces are permit-required confined space.

29 CFR 1910.305(b)(1)(ii): Unused openings in boxes, cabinets, or fittings were not effectively closed:   The employer does not effectively close unused openings on boxes, cabinets, or fitting. This violation was observed on or about February 20, 2014, where employees in the boiler operator's room operated the switches on a 110 VAC panel that had four open holes on the front door.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that unused openings in boxes, cabinets, or fittings are effectively closed.
