29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.  (a)  The employer did not require the workplace to be cleaned and have trash thrown away on a regular basis to keep it from piling up and filling up aisleways in storage and office areas, work benches, floor space, tables, and shelves, which created trip hazards and fire hazards, because smoking was permitted in the facility.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.141(d)(1): Washing facilities were not maintained in a sanitary condition:  (a)  On or about February 20, 2014, the restroom sink was covered with a piece of wood and a bucket, so the faucet was not visible and was not available for use, and it was covered in concrete dust.  (b)  On or about February 27, 2014, the restroom sink was covered in a thick layer of black grime, which contained concrete dust.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
