OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.    Laborer employees were exposed to a struck-by hazard on a daily basis while using a Budgit two ton underhung overhead hoist in the shop area to lift concrete burial lids and vaults weighing 800 lbs. and 1600 lbs. with the safety latch on the hook missing.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    The Company had not ensured that employees authorized to operate the sit-down propane forklift in the shop area had not been evaluated based upon their previous operating experience and training completed required by paragraph (l).

29 CFR 1910.184(e)(4): Proof testing. The employer shall ensure that before use, each new, repaired, or reconditioned alloy steel chain sling, including all welded components in the sling assembly, shall be proof tested by the sling manufacturer or equivalent entity, in accordance with paragraph 5.2 of the American Society of Testing and Materials Specification A391-65, which is incorporated by reference as specified in Sec. 1910.6 (ANSI G61.1-1968). The employer shall retain a certificate of the proof test and shall make it available for examination.    Four leg Alloy steel chain slings used in the shop area by employees in conjunction with an overhead hoist, were constructed from components and a welded ring had not been proof tested and a certificate of the proof test was not available for examination.

29 CFR 1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.    In the shop area, two, 2 ft. x 2 ft. plastic box fans designed for indoor use were being used in the dusty shop environment to blow concrete dust away from the mixing area.
