29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition: (a) At American Walnut LLC on or about April 28, 2014 the elevated surfaces of the plant were not kept clean and free of explosive dust. Dust on elevated surfaces was found as deep as 1/2 inch. A sample taken above a doorway along a passageway of the dust was tested and found to be explosive with an average Kst of 25 bar*meter/sec. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: (a) At American Walnut on or about April 28, 2014 employees were exposed to noise, and the employer had not assessed the workplace to determine if the levels of noise created a hazard to the workers that would require the workers to wear hearing protection. OSHA sampling conducted May 1, 2014 found workers exposed to peak noise as high as 130.3 dBA and 8-hour time weighted average exposure greater than 85 dBA at 87.0 dBA NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) At American Walnut on or about April 28, 2014 employees were exposed to dust, and the employer had not assessed the workplace to determine if the levels of dust in the air created a health hazard for workers that would require the use of personal protective equipment such as respiratory protection. (b) At American Walnut on or about April 28, 2014 employees were exposed to noise, and the employer had not assessed the workplace to determine if the levels of noise created a hazard to the workers that would require the workers to wear hearing protection. (c) At American Walnut on or about April 28, 2014 employees were exposed to electrical hazards, and the employer had not assessed the workplace to determine the arc flash hazard potential and the level of personal protective equipment workers should wear while performing switching and doing maintenance. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
