29 CFR 1904.7(b)(4)(i)(B): A physician or other licensed health care professional recommended that the employee not perform one or more of the routine functions of his or her job, or not work the full workday that he or she would otherwise have been scheduled to work: (a) On February 18, 2014, in the warehouse between Line #1 and the front offices, an employee was on a physician's recommendation that an employee be on work restrictions to work part-time and be on light duty. The employer failed to follow the physician's orders and ordered the employee to climb a ladder with an injured hand to paint the saddles of a work bar.

29 CFR 1910.179(j)(3): Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items. Any deficiencies such as listed shall be carefully examined and a determination made as to whether they constitute a safety hazard: (a) The crane deficiencies in Zenar crane, Serial Number 4244, located in the warehouse on Line #1, noted by a third party were not addressed and re-assessed by the employer to ensure that the inspection was complete.
