29 CFR 1910.1026(h)(3)(iii): The employer did not inform any person who laundered or cleaned protective clothing or equipment contaminated with chromium (VI) of the potentially harmful effects of exposure to chromium (VI) and that the clothing and equipment should be laundered or cleaned in a manner that minimizes skin or eye contact with chromium (VI) and effectively prevents the release of airborne chromium (VI) in excess of the permissible exposure limit:   a)  Smith Metal Works of Newark, Inc., on or about 2/27/14:  The employer did not inform their uniform service contractor about the harmful effects of exposure to chromium (VI) and that their work clothes should handled and laundered in a manner that minimizes skin, eye and respiratory exposure with chromium.

29 CFR 1910.1026(d)(2)(iii): The employer used the scheduled monitoring option, and monitoring revealed employee exposures to chromium (VI) to be at or above the action level; however, the employer did not perform periodic monitoring at least every six months:   a)  Smith Metal Works of Newark, Inc., on or about 2/12/2014:  The Employer did not perform periodic monitoring at least every six months when monitoring revealed employee exposures to chromium were above the action level of .0025 mg/m3.  Exposure monitoring was last completed on 7/27/2011.   Smith Metal Works of Newark, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1016(d)(2)(iii) which was contained in OSHA inspection number 162399, citation number 1, item number 2 and was affirmed as a final order on 4/6/2010, with respect to a workplace located at 1000 East Union Street, Newark, NY.
