29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about February 18, 2014, at the above addressed jobsite, the employer did not develop a hearing conservation program where employees in the grinding room were exposed to continuous noise at 68.41% of the action level of noise exposure (8-hour time weighted average of 85 dBA) or the equivalent sound level of approximately 87.2 dBA during the 391-minute sampling period; exposure calculations included a zero increment for the 89 minutes not sampled.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about February 18, 2014, at the above addressed jobsite, the employer did not provide Appendix D to employees who wear N95 respirators while performing grinding and sanding of metal parts in the grinding room and to employees using a full face respirator when testing system leaks with nitrous oxide gas.
