29 CFR 1926.404(b)(1)(i): General. The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors. a) 3rd floor: Employees used an electric powered circular saw to do framing work. The saw was connected to an extension cord, which was routed to a temporary outlet device installed on the 3rd floor. The saw and the connected extension cord were not provided with a ground fault circuit interrupter. On or about 02/25/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.405(b)(2): All pull boxes, junction boxes, and fittings shall be provided with covers. If metal covers are used, they shall be grounded. In energized installations each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear. a) 3rd floor: Employees used an electric powered circular saw to do framing work. The saw was connected to an extension cord, which was routed to a temporary outlet device installed on the 3rd floor. The temporary outlet was energized and the outlet box did not have a cover. On or about 02/25/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. a) 3rd floor: Employees were framing on the 3rd floor, which the entire floor was removed during ongoing demolition operations and was not fully decked to cover all floor holes and openings. Employees were exposed falling approximately 10 feet through holes to the 2nd floor. On or about 02/25/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM.
