29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: a) Front side, new townhome construction located at 13325 Flamingo Road, Milton, GA 30004. Employees were exposed to electrical shock hazards while plugging into a makeshift electrical outlet which was made of an electrical junction box, 14/2 Romex cord, cover plate and electrical tape. The electrical components used were not used as intended by the manufacturer as they were used outdoors and not fixed to a support within a structure.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Top plate, new townhome construction located at 13325 Flamingo Road, Milton, GA 30004. Employee was exposed to falls of approximately 9-feet, 8-inches while installing roof rafters from the top plate located over the garage with no fall protection system in place. Rudolfo Arriaga was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 954275, citation number 1, item number 2, and was affirmed as a final order on 02/28/2014, with respect to a workplace located at 1560 Roswell Street, Smyrna, GA 30080.
