29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501.   a) Each employee working from an unprotected steep slope roof, with unprotected sides and edges, is not protected by a fall protection system.  The employer does not require the use of any form of fall protection during roofing work.  This violation was most recently observed at 576 Branyan Trail, Milton, Georgia, lot 113 of the Crabapple Crossroads subdivision, where employees installing composite shingles working from an unprotected steep slope (8:12 pitch) roof were exposed to fall hazards of approximately 24-feet 5-inches to the ground.  To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  The employer, Pablo Lopez, was previously cited for a repeat violation of this occupational safety and health standard, CFR 29 1926.501(b)(13), or its equivalent standard which was contained in OSHA inspection number 538798, citation number 01, item number 001 and was affirmed as a final order on June 06, 2013, with respect to a workplace located at 1378 Park Brook Circle, Marietta, Georgia.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) Each employee mounting and dismounting an aluminum extension ladder is not protected by the ladder extending three feet above the upper landing surface.  The employer does not require the ladder to extend past the upper landing surface during its usage for access and egress. This violation was most recently observed at 576 Branyan Trail, Milton, Georgia, lot 113 of the Crabapple Crossroads subdivision, where employees use an aluminum extension ladder to access and egress from a steep pitched (10:12) roof with unprotected sides and edges approximately 14-feet 6-inches above ground level.   To abate this violation, the employer must ensure that its employees accessing and egressing upper levels are protected from falls and that not employee is allowed to use an extension ladder that is not properly installed.  The employer, Pablo Lopez, was previously cited for a repeat violation of this occupational safety and health standard, CFR 29 1926.1053(b)(1), or its equivalent standard which was contained in OSHA inspection number 538798, citation number 01, item number 002 and was affirmed as a final order on June 06, 2013, with respect to a workplace located at 1378 Park Brook Circle, Marietta, Georgia.
