29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). The employer does not ensure that employees are protected from falling while working at heights six feet or more. This violation occurred on or about February 28, 2014 when an employee was exposed to a fall hazard while doing framing work on the second level of a townhome being constructed without any means of fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees performing construction activities at heights six feet or more are protected from falling.
