29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: The employer does not provide a ladder or other safe means of egress in excavations 4 feet or more in depth. On or about March 5, 2014, at or near 100 Thompson St. in Diboll, TX, an employee was exposed to a caught-in hazard when replacing 2 inch gas distribution lines inside a 4'1' to 4'7" deep excavation without a safe means of egress. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a stairway, ladder, ramp or other safe means of egress is located in trench excavations that are 4 feet or more in depth.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. The employer does not protect employees working in excavations with accumulated water. This violation was observed on or about March 5, 2014, at or near 100 Thompson St. in Diboll, TX, where an employee was exposed to a caught-in hazard when installing a 2 inch natural gas distribution line inside of an excavation that had accumulated water in the bottom without taking adequate precautions. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that adequate precautions are taken to protect the employees working in excavations in which water has accumulated or accumulates.
