29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:     The employer does not protect employees from excavated material that could pose a hazard by falling or rolling into the excavation.  This violation was observed on or about August 4, 2015, at the job site where employees were exposed to a struck by hazard when working in an excavation that had the spoil piles at the edge of the excavation.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected by keeping excavated materials or equipment at least 2 feet from the edge of the excavation.

This violation was observed on or about August 4, 2015, at the job site where employees were exposed to a crushed-by hazard when working in an excavation that was 6 feet in depth without a protective system.        Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from cave-ins while working in excavations.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.       The employer did not conduct a daily inspection of a trench prior to the start of work on August 4, 2015.
