29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about March 7, 2014 and times prior thereto, employees of Fuentes Masonry, LLC performed bricklaying operations from scaffolding on an apartment complex building located at or near 10701 Buckhalter Haas Dr. in North Little Rock, Arkansas.  Employees were observed working and walking below the employees and materials on the scaffolding.  The employees working at lower levels were not wearing protective helmets, exposing the employees to overhead hazards.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):    On or about March 7, 2014 and times prior thereto, employees of Fuentes Masonry, LLC were observed bricklaying with the use of supported scaffolding at the apartment complex being constructed at or near 10701 Burkhalter Haas Dr. in North Little Rock, Arkansas.  Each platform on all working levels of the scaffolding were not fully planked or decked, exposing the employees to fall distances greater than 10 feet.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:    On or about March 7, 2014 and times prior thereto, employees of Fuentes Masonry, LLC performed bricklaying from scaffolding at the apartment complex being constructed at or near 10701 Buckhalter Haas Drive in North Little Rock, Arkansas.  The scaffolding legs did not bear on base plates, mud sills, or other adequate firm foundation, exposing the employees to fall hazards of greater than 10 feet to the ground level below.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, stucture, personnel hoist, or similar surface was not used.  Cross-braces were used as a means of access.    On or about March 7, 2014 and times prior thereto, employees of Fuentes Masonry, LLC were observed bricklaying from scaffolding at the apartment complex being constructed at or near 10701 Burkhalter Haas Drive in North Little Rock, Arkansas.  Employees were observed using cross-bracing and the frame of the scaffold as a means of access, exposing the employees to fall hazards of greater than 10 feet to the ground level below.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).    On or about March 7, 2014 and times prior thereto, employees of Fuentes Masonry, LLC were observed bricklaying on a scaffold at the apartment complex being constructed at or near 10701 Buckhalter Haas Drive in North Little Rock, Arkansas.  An employee was observed working from a platform on the three-tier scaffolding without protection from falling on the open side.  The employee was exposed to a falling distance of greater than 10 feet to the ground level below.
