29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Breezeway between AMR 03 buildings A & B: On or about February 27 and at times prior thereto, the controlling employer, Copper Basin Construction, Inc., failed to ensure that its sub-contractors were protected from an approximate 9.5 foot fall to concrete. Note: Abatement certification is NOT required.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: Note: When employees are using stilts, the top edge height of the top rail, or equivalent member, shall be increased an amount equal to the height of the stilts. (a) Breezeway between AMR 03 buildings A & B: On or about February 27 and at times prior thereto, the controlling employer, Copper Basin Construction, Inc., failed to ensure that its sub-contractors were protected from a fall to concrete with a guardrail only measuring 30.5 inches at the top. Note: Abatement certification is NOT required.
