29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  On or about March 11, 2014, at the Best Enterprises facility in Cabot, Arkansas, an employee who was operating paint spraying equipment was voluntarily wearing a MSA Advantage 200 half face dual cartridge respirator, while painting truck bumpers. The employee had not been medically cleared to wear a respirator. This condition exposed the employee to inhalation hazards.

29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by:  On or about March 10, 2014, in the Best Enterprises facility in Cabot, Arkansas, where employees were fabricating truck frames and tanks, employees were operating machines that were not guarded, exposing the employees to amputation and caught in hazards in the following instances:  a) The unused portion of the blade, outside the guide rollers, of the HYD-Mech F-10 horizontal band saw, used to make truck bed parts, was not guarded. b) The Milwaukee horizontal frame drill, used to drill holes in truck frames, did not have a chuck guard. c) The HTC 155 ton hydraulic press brake, used to made truck bed and tank parts, had an unguarded opening greater than 1/4 of an inch. d) The punch press station on the HMI Model 70-31 Iron Worker serial number  104-48-131, used to make frame brackets, had an unguarded opening greater than 1/4 of an inch. e) The HTC shear model number 750-10SR serial number A272526, used to make truck bed and tank parts, had an unguarded opening of more than 1/4 of an inch.

29 CFR 1910.334(a)(3)(ii): Attachment plugs and receptacles were connected or altered in a manner which prevented proper continuity of the electric equipment grounding conductor at the point where plugs were attached to receptacles:  On or about March 10, 2014, in the frame shop of the Best Enterprises facility in Cabot, Arkansas, where employees were fabricating truck frames, employees were operating plug and cord connected equipment with missing ground pins. These conditions exposed employees to the hazard of electric shock in the following instances:  a) The ground pin had been removed from the cord on the Milwaukee horizontal frames drill press that is used to drill holes in truck frames. b) The ground pin had been removed from the cord on industrial fan used to ventilate Bay 2, during painting operations.
