29 CFR 1910.1200(f)(6): Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with either the information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers or with the product identifier and pictures, symbols or combination thereof which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available  to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.     On or about March 10, 2014, employees used unlabeled beverage bottles to store paint, exposing employees to potentially unknown chemicals.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about March 10, 2014, the employer required the use of tight fitting respirators but had not developed and implemented a respiratory protection program.  The employees applying spray paint were exposed to an inhalation hazard.      Elements of a required respiratory program include, but are not limited to, medical evaluations for employees required to use respirators, fit testing for tight fitting respirators, training in use and care of respirator, and a change-out schedule for respirator cartridges.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   On or about March 10, 2014, the employer did not develop, implement and maintain a written hazard communication program to inform employees of the hazards of the chemicals they work with, exposing employees to hazards such as, but not limited to, inhalation and absorption of hazardous chemicals.
