Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards while operating forklifts without using the provided seatbelts:     (a) 7040 Battle Drive, Kennesaw, Georgia - Warehouse: the Toyota Electric Forklift Model 8FBCU25 was being operated without a seatbelt being used. This condition could cause crushed-by hazards if the employees were to be ejected from the lifts.

29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    a) 7040 Battle Drive, Kennesaw, Georgia - Chop Area: Employees are exposed to amputation hazards because the company has not established an Energy Control Program and the employees change the saw blades on the Miter saws.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws.  a) 7040 Battle Drive, Kennesaw, Georgia - Chop Area: An employee could be exposed to shock hazards while working with the C&H Thumbnail Master Machine frame joiner which had damaged strain relief to both where the cable entered the machine and at the plug end of the cable.
