Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards while operating forklifts without using the provided seatbelts: (a) 7040 Battle Drive, Kennesaw, Georgia - Warehouse: the Toyota Electric Forklift Model 8FBCU25 was being operated without a seatbelt being used. This condition could cause crushed-by hazards if the employees were to be ejected from the lifts.
