29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:     The employer does not protect employees by protective helmets in areas where there are possible dangers of head injury from impact, or falling objects. This violation was observed on or about March 11, 2014, where employees were exposed to struck-by hazards when installing brick siding on fabricated frame scaffolding without being protective with protective helmets.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in areas where there is a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are protected by protective helmets.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.   The employer does not provide the employees with protection from falling hand tools, debris and other small objects. This violation was observed on or about March 11, 2014, where employees were exposed to struck-by hazards when installing brick siding on fabricated frame scaffolding without installing toeboards, screens, nets or canopies to deflect falling objects.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee on a scaffold is provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrails systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.      The employer does not install each platform unit so that the spaces between adjacent units are no more than 1 inch. This violation was observed on or about March 11, 2014, on the west side of single family dwelling where an employee was exposed to a 14 foot fall hazard when installing masonry bricks on a set of fabricated frame scaffolding without the space between the planks being no more than 1 inch.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each platform unit is installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch.

Crossbraces were used as a means of access.     The employer does not ensure that employees are provided with a point of access for scaffold platforms. This violation was observed on or about March 11, 2014, on the west side of single family dwelling where an employee was exposed to a 14 foot fall hazard when installing masonry bricks on a set of fabricated frame scaffolding without a safe means of access.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each scaffold platform is provided a point of access, portable ladder, hook-on ladder, attachable ladder, stair tower, stairway-type ladder, ramp, walkway, prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface.
