OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being crushed or struck by falling objects as a result of damaged storage racks.   a) Clark Associates Inc., DBA The Restaurant Store, Warehouse Area - On or about March 14, 2014, steel storage racks were not installed so as to prevent damage or collapse if the racks were struck by forklifts.  The rack support columns were not anchored to the floor as required by the manufacturer.    b) Clark Associates Inc., DBA The Restaurant Store, Warehouse Area - On or about March 14, 2014, steel storage racks with damaged vertical columns were not immediately unloaded and the damaged portions were not repaired or replaced.  ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement is to follow the manufacturer's installation instruction and to ensure the structural integrity of the storage racks is maintained through a program of routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI Standard MH16.1-2008 (Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks and Commentary to ANSI Standard MH16.1-2008, which requires that every column base-plate be anchored with at least one anchor, and recommends the installation of column protection devices.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using improperly maintained mobile ladder stands.   a) The Restaurant Store, Warehouse Area - On or about March 14, 2014, a mobile ladder stand being used by a management employee was not properly fitted with the rubber safety stops required to prevent movement when the ladder was in use.  Clark Associates, Inc. DBA The Restaurant Store was previously cited for a violation of this occupational safety and health standard or its equivalent standard Section 5(a)(1), which was contained in OSHA inspection number 611160, citation number 01, item number 01 and was affirmed as a final order on November 27, 2012, with respect to a workplace located at 1633 Airport Road Allentown, PA 18109.  ABATEMENT NOTE:  Among other methods, one feasible and acceptable abatement method to correct this hazard is: Comply with the manufacturer's requirements and ANSI A14.7-1991 for Mobile Ladder Stands and discontinue use until repairs are completed. Units that are damaged or weakened from any cause shall not be used until repairs are completed.  Units that are damaged subsequent to their receipt, and/or are worn beyond repair shall be destroyed.  Never climb a damaged ladder stand or ladder.
