OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with being crushed or struck by falling objects as a result of damaged storage racks.     a) Clark Associates Inc., DBA The Restaurant Store, Warehouse Area - On or about October 21, 2014, a steel storage rack was not installed so as to prevent damage or collapse of the racks by being struck by forklifts in that the rack support columns were not anchored to the floor.      b) Clark Associates Inc., DBA The Restaurant Store, Warehouse Area - On or about October 21, 2014, a steel storage rack with a damaged vertical column and horizontal brace member was not immediately unloaded and the damaged portions were not repaired or replaced.        c) Clark Associates Inc., DBA The Restaurant Store, Storefront Area - On or about October 21, 2014, a Lozier brand multi-function shelving system was modified with a wider bottom shelf which placed the vertical columns out of plumb.    Clark Associates Inc., DBA The Restaurant Store, was previously cited for a violation of this occupational safety and health standard OSH ACT of 1970 Section (5)(a)(1), or its equivalent standard, which was contained in OSHA inspection number 963149, citation number 1, item number 1 and was affirmed as a final order on August 15, 2014, with respect to a workplace located at 1633 Airport Road Allentown, PA 18109.    ABATEMENT NOTE:  Among other methods, one feasible and acceptable abatement is to follow the manufacturer's installation instruction and to ensure the structural integrity of the storage racks is maintained through a program of routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI Standard MH16.1-2008. (Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks) and Commentary to ANSI Standard MH16.1-2008, which requires that every column base-plate be anchored with at least one anchor, and recommends the installation of column protection devices.
