29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) At the Corner of Howells Ferry Rd and Schillinger Rd in Semmes, Alabama:  On or about March 12, 2014 and at times prior; the employer exposed his employee to cave-in hazards in that employees were allowed to work inside a four foot trench with a three foot tall spoil pile that was placed directly on the edge of the excavation which could fall or roll into the excavation injuring the employee.
