29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury, in that:  a) 3333 Schillinger Rd. N, Semmes, AL; On or about February 12, 2016; employees entered and worked in a trench measuring up to 7 feet deep that was not protected from cave-ins by an adequate protective system.  Employees had not been provided effective information and training on recognizing and avoiding cave-in hazards on the work site.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   a) 3333 Schillinger Rd. N, Semmes, AL; On or about February 12, 2016 the employer exposed employees to cave-in hazards in that employees were not provided a means of safe egress while working in a 7 ft deep trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section:   a) 3333 Schillinger Rd. N, Semmes, AL; On or about February 12, 2016 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring up to 7 feet deep, 25 wide, and 32 feet in length that was dug in class B soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) 3333 Schillinger Rd. N, Semmes, AL:  On or about February 12, 2016 and at times prior; the employer exposed his employee to cave-in hazards in that employees were allowed to work inside a 7 ft deep trench with a spoil pile that was placed directly on the edge of the excavation which could fall or roll into the excavation injuring the employee.  b) 3333 Schillinger Rd. N, Semmes, AL:  On or about February 12, 2016 and at times prior; the employer exposed his employee to cave-in hazards in that employees were allowed to work inside a 7 ft deep trench with a Hitachi 270LC excavator that was placed directly on the edge of the excavation.  Frank Turner Construction Co. Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2) which was contained in OSHA inspection number 963262, citation number 1, item number 1 and was affirmed as a final order on May 1, 2014 with respect to a workplace located North of Howells Ferry Rd And Schillinger Rd, Semmes, AL 36575.
