OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to struck-by hazards from potentially defective hoists due to the lack of an inspection program: a) Tetra Tool Company / 1425 Industrial Drive, Erie PA: On or about March 14, 2014, the company utilizes various hoists throughout the facility to move the product from one station to the next. Hoists include, but are not limited, to the Lifttech Budgit Electric Hoist (motor model 428049-8A) located in the Mori Seiki room and Lifttech Budgit Electric Hoist (motor model X2X049-8) located in the work room did not undergo a regular and documented inspection program.
