29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a) at the concrete crushing plant an employee picking trash off crush concrete and cleaning crusher areas was exposed to continuous noise levels at 190.6% of the allowable 8 hour TWA (85 dBA). The equivalent dBA level of this dose % is 94.6 dBA. The sampling was performed for 460 minutes during one shift on April 22, 2014.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. a) for the employees at 9301 Denton Avenue, Hudson (FL) required to use a Northern Safety & Industrial 7210 N95 Disposable Particulate Respirator (7210) while working at the crusher, as observed on or about April 22, 2014. The respirators were required to be used when cleaning crusher areas. As indicated by paragraphs (i - (ix) above, elements required by the program include but are not limited to: medical evaluations, fit-testing and training.
