29 CFR 1910.106(b)(2)(vii)(a): Area(s) surrounding tank(s) containing flammable liquids were not provided with adequate drainage or dikes:  On or about March 18, 2014, at the Wepfer Marine facility located at 3696 Shar-Cal Road in Calvert City, KY, the employer had 2 - 500 gallon above ground gasoline tanks on site and did not have any drainage or diking established to protect adjacent waterways from leakage and/or spillage.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not comply a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet  On or about march 18, 2014, at the Wepfer Marine facility located at 3696 Shar-Cal Road in Calvert City, KY, employees were exposed to various hazardous materials (include but not limited to gasoline, diesel fuel, irritants (paints, cleaners, unlabeled hazardous chemicals) for which the employer did not maintain a complete list of hazardous materials used at the work site.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemical(s) contained therein (Maritime Reference: 1915.1200):  (a) On or about March 18, 2014, at the Wepfer Marine facility located at 3696 Shar-Cal Road in Calvert City, KY, employees were exposed to unlabeled hazardous chemical containers in their work areas.  This condition exposed employees to injury and illness from acute and/or chronic exposure to chemicals.  1) Unlabeled 12-24 oz. cans of unknown liquid (possibly Sherwin Williams Hi Solids Polyurethane).  2) Unlabeled 12-24 oz. spray cans of unknown liquid.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about March 18, 2014, at the Wepfer Marine facility located at 3696 Shar-Cal Road in Calvert City, KY, the employer had 2 - 500 gallon gasoline tanks on site and employees were exposed to physical hazards from flammable liquids that were not protected against collision damage from vehicles driven in the area.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
